Terms of Service

These Terms of Service (“Terms”) govern your use of Forge Engine, a service operated by Nimbus Compute Ltd (“Forge Engine”, “we”, “us”). By creating an account or otherwise using Forge Engine you agree to these Terms. If you do not agree, please do not use the service.

1. Definitions

  • Account: the credentials and profile you create to use Forge Engine.
  • User Content: anything you upload, submit, or link to (videos, URLs, captions, ratings).
  • Output: the clips, transcripts, captions, titles, and metadata Forge Engine produces from your User Content.
  • Service: the Forge Engine application and the associated APIs at forgeengine.io.

2. Eligibility and Accounts

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. You are responsible for keeping your account credentials secure and for everything that happens under your account. Notify us at support@forgeengine.io if you suspect unauthorised use.

3. Your User Content

You retain ownership of your User Content and your Output. By uploading User Content you grant Forge Engine a worldwide, non-exclusive, royalty-free licence to host, process, transcode, and deliver that content solely as needed to provide the Service to you.

You represent and warrant that you have all necessary rights, licences, and permissions to upload and process the User Content (whether because you own it, the rights-holder has authorised you, or your use is otherwise permitted by law). You are solely responsible for the consequences of uploading User Content you do not have the right to use.

We will never use your User Content or Output to train AI models, ours or anyone else’s. See the Privacy Policy for details.

4. Acceptable Use

You agree not to:

  • Process content you do not have the right to process.
  • Use the Service to produce material that is unlawful, defamatory, harassing, or that violates anyone’s privacy or intellectual- property rights.
  • Attempt to circumvent authentication, rate limits, quotas, or signed-URL protections.
  • Reverse-engineer, scrape, or otherwise extract the Service for the purpose of replicating it.
  • Use the Service to send spam, deliver malware, or facilitate any illegal activity.
  • Resell access to the Service without our written permission.

5. Plans, Payment, and Cancellation

Forge Engine offers a free tier and one or more paid plans, plus optional top-up packs. Pricing for each plan is shown on the pricing page and confirmed in the checkout flow before payment.

Paid subscriptions are billed monthly in advance through Stripe. By paying, you authorise Stripe to charge the payment method you provide for the recurring fee until you cancel. Top-up packs are one-time charges.

You may cancel your subscription at any time from Settings → Billing(which redirects to the Stripe customer portal). Cancellation takes effect at the end of your current billing period; you keep access to the minutes you’ve already paid for through to the end of that period. We do not offer pro-rata refunds for partial months.

Failed jobs do not count against your monthly minute allowance. If a job fails through our fault we will refund the minutes automatically.

We may change pricing for new billing periods on at least 30 days’ notice (delivered to the email on your account). Continued use after the notice period constitutes acceptance.

6. Service Availability

We aim for high availability but do not promise an uninterrupted Service. From time to time we may need to perform maintenance, fix bugs, or respond to incidents. Status is published on the status page.

7. Suspension and Termination

We may suspend or terminate your account if you breach these Terms, misuse the Service, or expose us to legal risk. Where reasonable we will give notice and a chance to fix the issue before suspending. You may delete your account at any time from Settings → Data & Privacy; deletion removes your profile, jobs, and stored media.

8. Intellectual Property

The Forge Engine name, logo, software, and the design of the Service are the property of Nimbus Compute Ltd and are protected by intellectual- property laws. Nothing in these Terms transfers any of those rights to you. The licence we grant you to use the Service is non-exclusive, non-transferable, and revocable on the conditions in these Terms.

9. Warranties and Disclaimers

Except as expressly set out in these Terms or required by law, the Service is provided “as is” and “as available”. We do not warrant that:

  • The Service will be uninterrupted or error-free.
  • Any specific clip will be of a particular quality, score, or virality.
  • Output will be free from rendering defects in every case.

To the maximum extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

Nothing in these Terms limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) anything else that cannot be excluded or limited under applicable law.

Subject to the above, our total aggregate liability arising out of or in connection with the Service is limited to the greater of (i) the fees you actually paid us for the Service in the 12 months preceding the claim, and (ii) GBP 100. We are not liable for indirect, consequential, or special losses, loss of profits, loss of revenue, loss of business, or loss of data.

11. Indemnity

You agree to indemnify and hold Nimbus Compute Ltd harmless from any third-party claim arising out of (a) your User Content, (b) your breach of these Terms, or (c) your violation of any law or third-party right. We will tell you promptly about any such claim and you may control the defence at your expense.

12. Changes to the Service or Terms

We may update the Service and these Terms from time to time. Material changes will be surfaced in-product before they take effect, and the “Last updated” date at the top of this page will be revised. Continued use of the Service after changes take effect constitutes acceptance.

13. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any disputes arising out of or in connection with these Terms or the Service. If you are a consumer this clause does not affect any non-waivable rights you have under the laws of your country of residence.
